NATIONALLY COORDINATED CRIMINAL HISTORY CHECKS DISPUTE POLICY
MARTIAN LOGIC PTY LIMITED ACN 089 846 846 (“Martian Logic”)
1. STATEMENT OF INTENT
1.1 Martian Logic is committed to dealing with any disputes regarding the results of Nationally Coordinated Criminal History Checks (NCCHC) in a fair and expeditious manner.
1.2 The purpose of this Policy is to outline what steps an applicant for a NCCHC can take if he or she wishes to dispute the result or outcome of a NCCHC (Result) and how Martian Logic will manage the dispute.
1.3 In this policy:
(a)
“you” and “your” refers to a person who has made an application for a NCCHC through Martian Logic;

(b)
“we”, “us” and “our” refers to Martian Logic.
2. CONTACT US
2.1 If you wish to dispute the result or outcome of a NCCHC for an application which you have submitted through us, the first step is to contact us in writing and advise us that you wish to dispute the Result (Dispute Notification).
2.2 You may lodge a Dispute Notification by sending an email or letter using the following contact details:

2.3 Your Dispute Notification must include the following information:
(a)
your contact information, including any other names by which you are known or have been known (such as a maiden name) and your current and previous residential addresses;

(b)
the reason why you are disputing the Result, which must be one or more of the following reasons:
(i)
all of the police information released does not belong to you;

(ii)
part of the police information released does not belong to you;

(iii)
the police information released is your information but it is inaccurate;

(iv)
the police information released is your information but should not have been released;

(v)
police information belonging to you has not been released;

(c)
any documents you have that support your dispute of the Result.
2.4 After we received your Dispute Notification, we may request that your provide us with further information to assist your dispute of the Result.
3. DISPUTE PROCESS
3.1 After we receive your Dispute Notification, we will complete a dispute form on your behalf and lodge it into a national database where it will be reviewed by the relevant police agency (Relevant Agency) that was responsible for the release of information for your NCCHC result.
3.2 We will also notify the National Police Check Service that we have lodged a dispute on your behalf.
3.3 The Relevant Agency may request further information before it can resolve the dispute, in which case, we will notify you of the request and ask you to provide the further information to us so we can forward it to the Relevant Agency.
3.4 Once the Relevant Agency has conducted its review of your dispute, it will advise us of the outcome of its review which will result in either one of the following:
(a)
successful dispute outcome – this means that your dispute of the Result was successful and the Result will be amended to reflect this;

(b)
unsuccessful dispute outcome – this means that your dispute of the Result was not accepted and the Result will remain unchanged.

4. NOTIFICATION OF DISPUTE RESULT
4.1 The dispute resolution process may take up to two weeks after we have lodged a dispute form on your behalf.
4.2 Once we have been advised of the outcome, we will notify you of the outcome by email.
